Terms of service
The basic terms that apply when accessing this website or using DigiCards4Biz services.
Supplier information
DigiCards4Biz is operated by StringLite CC, a South African close corporation trading as DigiCards4Biz. Registration number: 2000/005808/23. VAT number: 4760229882.
Email: info@digicards4biz.com. Telephone: +27 83 226 7588. The website address is https://www.digicards4biz.com/.
Hosted service and access
DigiCard is a hosted online service. While your plan is active and paid, DigiCards4Biz grants you a limited, non-exclusive, non-transferable right to access and use the service for your own lawful business purposes. The service, software, platform, templates and underlying technology remain owned by DigiCards4Biz or its licensors and are not sold to you.
You must provide accurate information, keep account credentials secure, use the service lawfully and avoid content or activity that infringes rights, misleads others, disrupts the platform or compromises security. Access depends on a supported internet connection and may be affected by planned maintenance, security work or circumstances outside our reasonable control.
Your content
You retain ownership of information and media that you upload or supply. You grant DigiCards4Biz the limited permission needed to host, copy, process and display that content solely to provide, secure and support the service.
You remain responsible for that content and must have permission to use it and to contact recipients where required. You should retain your own original copies of uploaded content.
Plans and payment
Services, plan limits, setup assistance and update work are supplied according to the selected quotation or published pricing. Published DigiCard prices include 15% South African VAT. For an annual order, South African VAT is removed at checkout only when the billing address is outside South Africa and the DigiCards will not be used by a South African company, branch, division, office, employee or representative. Otherwise South African VAT applies, even if payment is made from another country. Prices and the payment period are shown before an order is submitted.
You are responsible for accurately declaring whether any DigiCards will be used by a South African company, branch, division, office, employee or representative. If the information supplied is incomplete or inaccurate, we may correct the VAT treatment and recover any resulting tax shortfall, or refund or credit any resulting overpayment, as applicable. We may also adjust the VAT treatment where required by law or by the South African Revenue Service.
Annual plan fees are payable in full in advance for the coming 12-month service period. Monthly plan fees are payable monthly in advance by debit order. New service may be activated only after the applicable payment or debit-order mandate has been accepted. Continued access requires payments to remain up to date.
When the agreement starts
Submitting an order is an offer to purchase the selected service. Accepting these terms does not by itself require DigiCards4Biz to activate an account. For an annual credit-card order, the agreement becomes binding when payment has been successfully confirmed and we accept the order. For a monthly debit-order plan, the agreement becomes binding when we approve the submitted mandate and confirm acceptance of the order. We may decline an order and will refund any payment received for an order we do not accept.
Renewal and price changes
A monthly plan continues from month to month until cancelled in accordance with these terms. An annual plan runs for 12 months and requires payment for a further 12-month period to renew. We will send an annual renewal notice approximately two months before the renewal date, a renewal invoice approximately one month before that date, and a payment reminder on or around the 15th day of the renewal month if payment remains outstanding. If the renewal payment has not been received by the renewal date, the service may expire or be suspended.
We may change plan prices by giving at least two months' notice. A price change for an annual plan applies only from its next renewal. A price change for a monthly plan applies no earlier than the first monthly billing date after the notice period has expired.
Cooling-off and statutory rights
Nothing in these terms limits a right or remedy that cannot lawfully be limited. Where the Electronic Communications and Transactions Act, the Consumer Protection Act or another applicable law gives you a cooling-off, cancellation, refund or service-quality right, that right continues to apply.
Cancellation by you
You may cancel by giving written notice through our contact form or to info@digicards4biz.com. We require 20 business days notice in a recorded form, except where applicable law permits a shorter notice period.
For monthly billing administration, service will normally continue until the end of the calendar month in which the 20-business-day notice period expires. If applicable law requires cancellation to take effect earlier, the earlier date will apply and any amount collected for service after that date will be credited or refunded.
Refunds and prepaid annual plans
Monthly fees already applied to service provided up to the effective cancellation date are not refundable, except where required by law or where the service was not supplied to the required standard.
For an annual plan cancelled before the end of its prepaid service period, the monthly refund value is the annual fee actually paid divided by 12. We will credit or refund that value for each complete unused month remaining after the month in which cancellation takes effect, less any amount already owed and any reasonable cancellation charge permitted by law. Any statutory cooling-off or refund right takes priority over this calculation.
Suspension and termination
If a debit order is returned, the service will remain active through the 15th day of that month. Access will be suspended from the 16th only if neither a direct payment has been made before the 15th of that month nor a payment arrangement has been agreed with us.
We may also suspend access to protect the service, other users or third parties, or where we reasonably believe the service is being used unlawfully or in material breach of these terms. Where applicable law requires it, we will give written notice of a material breach and at least 20 business days to remedy it before terminating the agreement. We may act sooner where law permits urgent action for security, fraud, unlawful conduct or serious harm.
After cancellation or termination
Access to the hosted service ends on the effective cancellation or termination date. The account will then be blocked for 30 days before client-uploaded content and related account information are deleted from the active service. You should retain your own originals because DigiCards4Biz does not provide a content-export service.
We may retain invoices, payment records, acceptance records, correspondence and other information for as long as reasonably required by tax, accounting, dispute-resolution or other legal obligations. Amounts lawfully due up to the effective end date remain payable.
Notices
Cancellation and other formal notices to DigiCards4Biz must be sent through our contact form or to info@digicards4biz.com and must include enough information to identify the account. A notice is treated as received when it enters our information system in readable form, unless the sender receives a delivery-failure message. We may send notices to the most recent email address recorded for the account. You are responsible for keeping that address current.
Governing law and disputes
These terms and the agreement are governed by the laws of the Republic of South Africa. This choice does not remove any mandatory consumer protection that applies to you in your country and cannot lawfully be excluded by agreement.
Before starting formal proceedings, each party should give the other written details of the dispute and allow at least 20 business days for a good-faith attempt to resolve it. If the dispute is not resolved, it may be brought before a court with jurisdiction in South Africa, subject to any right you may have under mandatory law to use another court, tribunal or consumer-protection body.
General terms
You may not assign or transfer the agreement without our prior written consent. We may assign the agreement as part of a transfer of the service or our business, provided this does not reduce rights that cannot lawfully be reduced.
A failure or delay in enforcing a right is not a waiver of that right. If any provision is found invalid or unenforceable, it will be limited or removed only to the extent necessary and the remaining provisions will continue to apply.
These terms, the accepted order, the published plan details and any written quotation expressly incorporated into the order form the entire agreement for the service and replace earlier discussions about the same subject. If they conflict, a specifically accepted written quotation takes priority over the published plan details, and these terms apply to all remaining matters.
We may update these terms for legal, security, operational or service reasons. Changes will not retrospectively alter an accepted order. Material changes affecting an active service will be notified in advance and will apply from the next renewal or billing period after any required notice, unless an earlier change is required by law or is necessary to address an urgent security risk.
Availability and changes
We work to keep the service available and information current, but maintenance, security requirements or circumstances outside our control may occasionally affect access. Features may evolve as the platform improves.
Liability
To the extent permitted by law, DigiCards4Biz is not responsible for indirect loss arising from website use, third-party services, user-supplied content or unauthorised use of account credentials.
